CLIENT ALERT: Executive Office for Administration and Finance Launches COVID-19 Emergency Paid Sick Leave Website with Guidance and Required Notice

On May 28, 2021, Governor Charlie Baker signed into law new legislation ordering Massachusetts employers to provide employees up to 40 hours of COVID-19 emergency paid sick leave, discussed in further detail here. On June 4, 2021, the Executive Office for Administration and Finance launched a COVID-19 Temporary Emergency Paid Sick Leave Program website, which contains information on the new law, and also provides the required employer notice.

Now that the notice is available employers must:

(1) post the notice in a conspicuous location accessible to employees in every establishment where eligible employees work; and

(2) provide a copy of the notice to each employee.

The law provides that if an employer does not maintain a physical workplace, or an employee teleworks or performs work through a web-based platform, notification can be provided via electronic communication or a conspicuous posting in the web-based platform.

MBJ will continue to monitor and update clients on new developments in this law. Employers with questions about notice obligations or the new COVID-19 emergency paid sick leave law should consult with their MBJ attorney.
